1. Professional Advisory & Mandate Nature
CERISE SAS provides customized commercial property administration, technical audits, and asset governance services under French law. Because deliverables involve tailored research, cadastral inspections, and specialized intellectual execution, policy terms are structured to balance client flexibility with committed professional resources.
2. Statutory Right of Withdrawal (Cooling-Off Period)
In accordance with Article L. 221-18 of the French Consumer Code (Code de la Consommation) where applicable to non-professional clients contracting off-premises or remotely:
- Clients have a statutory period of 14 calendar days from contract signing to exercise their right of withdrawal without giving reasons or incurring penalties.
- If the client explicitly requests performance of the advisory services to begin before the expiry of the 14-day period, the client shall remain liable to pay an amount proportional to the services already provided up to the date of withdrawal notification.
3. Termination of Recurring Property Administration Mandates
For ongoing commercial property administration contracts (mandats d'administration et de gestion):
- Mandates are established for a fixed initial term (typically 12 to 36 months) with annual tacit renewal.
- Either party may terminate the mandate upon giving written notice by registered letter with acknowledgment of receipt (LRAR) adhering to the contractual notice period (generally 3 months prior to anniversary).
- Upon termination, CERISE SAS delivers a comprehensive transition dossier, reconciles tenant security deposits, and hands over accounting ledgers to the appointed successor administrator.
4. Technical Audits & Milestone Deliverable Refunds
For fixed-price technical due diligence, valuation reports, or energy diagnostic mandates:
- Prior to Inspection: If a scheduled audit is canceled by the client more than 48 business hours prior to the physical site visit, any deposit paid is refunded minus a 10% administrative file opening fee.
- Post-Inspection / In Progress: Once on-site technical inspection has occurred or document review has commenced, fees incurred for completed work stages are non-refundable.
- Quality Review & Rectification Guarantee: If an delivered report contains factual or cadastral errors attributable to our analysis, CERISE SAS will rectify and re-issue the audited dossier at no additional charge within 5 business days.
5. Dispute Mediation & Resolution
In the event of a disagreement regarding billing or service execution, clients are encouraged to contact Managing Director Dominique Houdmond directly. Failing amicable resolution, clients may refer the dispute to an accredited European commercial mediator or the competent courts of the Tribunal de Commerce de Nantes, France.
